1. Agreement and Acceptance

These Terms of Service ("Terms") govern your use of the podgoricacars.com website and any car hire reservation made through our platform. By accessing this site or completing a booking, you confirm that you have read, understood, and agreed to be bound by these Terms in full.

Podgorica Cars operates as an intermediary platform connecting travelers with licensed car hire suppliers based in Podgorica, Podgorica Municipality, Montenegro. The vehicle rental contract you enter into at the point of collection is directly between you and the relevant supplier. These Terms apply to your use of our platform and the booking services we facilitate.

We reserve the right to update these Terms at any time. Continued use of the platform following any update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically, particularly before making a new reservation.

2. Eligibility Requirements for Car Hire in Podgorica

To reserve a vehicle through Podgorica Cars, you must meet the following eligibility criteria at the time of booking and at vehicle collection.

Minimum Age for Standard Vehicles

The minimum age to rent a standard or economy class vehicle in Podgorica is 21 years. Drivers aged 21 to 24 may be subject to a young driver surcharge, typically ranging from EUR 5 to EUR 10 per rental day. This surcharge is charged directly by the supplier and will be disclosed during the booking process.

Minimum Age for Premium and Luxury Vehicles

For premium, luxury, or high-capacity vehicles including large SUVs, minivans, and executive sedans, the minimum driver age is 25 years. Some suppliers operating out of Podgorica airport and the city centre may apply stricter age thresholds for specific vehicle categories. These requirements are displayed on each vehicle listing before you confirm your reservation.

Driving License Requirements

All drivers must hold a valid, full driving license that has been held for a minimum of one year prior to the rental start date. Driving licenses issued in EU member states, the United Kingdom, the United States of America, Canada, Australia, and New Zealand are generally accepted for car hire in Montenegro without additional documentation.

If your national driving license is issued in a language that does not use the Latin alphabet, you are required to carry a valid International Driving Permit (IDP) alongside your national license. This requirement applies regardless of your nationality and is enforced by local suppliers in compliance with Montenegrin traffic regulations. Failure to present the required documentation at collection may result in the supplier declining the rental without refund.

All drivers listed on the rental agreement must present their driving license at the time of vehicle collection. Additional drivers listed on a booking must also satisfy all age and license eligibility requirements.

3. Reservations, Cancellations, and No-Show Policy

Reservations made through Podgorica Cars are subject to availability and are confirmed only upon receipt of a booking confirmation email from our platform. Placing a vehicle in your cart does not constitute a confirmed reservation.

Free Cancellation Policy

The majority of vehicles listed on our platform are available with free cancellation up to 48 hours before the confirmed pick-up time, whether at Podgorica International Airport, a city centre location, or a hotel delivery address. Where free cancellation is available, this is clearly stated on the vehicle listing and your booking confirmation. If your booking qualifies for free cancellation, you may cancel at no charge within the stated window by accessing your booking details and selecting the cancellation option.

Non-refundable bookings or prepaid deals are clearly labeled as such before you complete payment. For these bookings, no refund will be issued following cancellation regardless of the notice given.

No-Show and Late Cancellation

If you fail to collect the vehicle at the agreed pick-up time and location without prior cancellation, this is treated as a no-show. No-show fees may apply and will be communicated in your booking documentation. In the event of a flight delay affecting your arrival at Podgorica airport, please contact the supplier directly using the contact details provided in your confirmation email. Suppliers will make reasonable efforts to accommodate late arrivals, but are not obligated to hold a vehicle indefinitely.

Supplier Cancellations

In rare circumstances, a supplier may be unable to fulfill a confirmed booking due to unforeseen operational issues. In such cases, Podgorica Cars will make reasonable efforts to source an equivalent or superior vehicle at no additional cost to you. Where a suitable alternative cannot be arranged, a full refund will be issued promptly.

4. Pricing, Payment, and Optional Extras

All prices displayed on podgoricacars.com are quoted in Euros (EUR), which is the standard currency used for car hire transactions in Montenegro. Prices shown include the base rental rate and, unless otherwise stated, basic third-party liability insurance and unlimited mileage for domestic travel within Montenegro.

What Is Included in the Quoted Price

Unless a vehicle listing specifies otherwise, the following are included in the base hire price shown on our platform: unlimited mileage within Montenegro, basic Collision Damage Waiver (CDW) with applicable excess, theft protection, and roadside assistance coverage valid within Montenegro and certain designated neighbouring countries.

Optional Extras and Add-Ons

The following optional extras may be added to your reservation during the booking process or requested at the point of vehicle collection, subject to availability and supplier policies:

• GPS navigation unit - typically EUR 3 to EUR 7 per day
• Child seat (infant, toddler, or booster) - typically EUR 3 to EUR 5 per day
• Additional driver - typically EUR 5 to EUR 8 per day per driver
• Wi-Fi hotspot device - available from select suppliers
• Full coverage insurance upgrade with zero excess
• Cross-border travel permit for travel into Croatia, Bosnia and Herzegovina, Serbia, or Albania

Prices for optional extras are set by individual suppliers and may vary. All applicable extra charges will be disclosed before you confirm your booking.

Fuel Policy

The fuel policy applicable to your rental will be stated on the vehicle listing and in your booking confirmation. The most common policy for car hire in Podgorica is "full-to-full," meaning the vehicle is provided with a full tank and must be returned with a full tank. Failure to return the vehicle with the agreed fuel level may result in a refuelling charge applied by the supplier. Some suppliers offer a prepaid fuel option at a fixed price, which allows you to return the vehicle with any fuel level.

Currency and Surcharges

Additional charges applied at the counter by the supplier, including one-way drop-off fees, young driver surcharges, and airport service fees for collection at Podgorica International Airport, are payable directly to the supplier in EUR. Podgorica Cars is not responsible for charges applied by suppliers beyond the base booking price confirmed through our platform.

5. Vehicle Use Rules and Prohibited Activities

All rental vehicles must be used in a lawful manner and in accordance with the traffic laws of Montenegro and any other country in which the vehicle is driven. By accepting the rental agreement at collection, you agree to the following conditions of use.

Permitted Use

Vehicles may be used for personal or business travel within Montenegro and in any additional countries specifically permitted under a cross-border extension purchased through your booking or directly with the supplier. Common routes from Podgorica include travel to Budva, Kotor, Bar, Niksic, Kolasin, and Zabljak. Cross-border travel to Croatia, for example to Dubrovnik via the Debeli Brijeg border crossing, is frequently permitted but must be pre-arranged and confirmed in writing by the supplier.

Prohibited Activities

The following activities are strictly prohibited and will void insurance cover and may result in legal liability:

• Off-road or unsurfaced track driving unless the vehicle is explicitly designated and insured for off-road use
• Participation in any form of motor racing, rallying, speed testing, or organised competitive driving event
• Subletting or lending the vehicle to any person not listed as a driver on the rental agreement
• Operating the vehicle while under the influence of alcohol, controlled substances, or any medication that impairs driving ability, in accordance with Montenegrin law
• Using the vehicle for commercial transportation of fare-paying passengers including rideshare or taxi services
• Transporting any illegal substances, firearms, or prohibited goods
• Towing another vehicle or trailer without written authorisation from the supplier
• Driving the vehicle outside the countries permitted under your rental agreement
• Intentional damage to the vehicle or use of the vehicle in a manner likely to cause damage

Violation of any prohibited activity may result in immediate termination of the rental, full financial liability for any damage or loss, and potential legal proceedings under applicable Montenegrin law.

6. Insurance and Liability

Car hire through Podgorica Cars includes basic third-party motor liability insurance as required by Montenegrin law. This covers damage or injury caused to third parties in the event of an accident for which the driver is at fault.

Collision Damage Waiver (CDW)

Basic CDW is included in the majority of vehicle hire prices on our platform. CDW limits your financial liability in the event of accidental damage to the rental vehicle. However, basic CDW typically applies an excess (also referred to as a deductible), which represents the amount you remain liable for in the event of a claim. The applicable excess amount varies by vehicle category and supplier and is disclosed on each listing. Standard excess amounts for car hire in Podgorica range from EUR 200 to EUR 1,500 depending on the vehicle class.

Optional Full Coverage with Zero Excess

You may purchase a full coverage upgrade that reduces your liability excess to zero. This option is available during booking or at the counter and provides comprehensive protection including coverage for damage to wheels, tyres, glass, and the undercarriage of the vehicle - areas frequently excluded from basic CDW on Montenegrin mountain roads and rural routes.

Exclusions from Insurance Cover

Insurance cover is void in any circumstances involving prohibited activities as outlined in Section 5 above, including driving under the influence of alcohol or drugs, unauthorised drivers, or travel outside permitted territories. Damage caused by negligence, deliberate acts, or failure to follow road safety regulations will be the sole financial responsibility of the renter.

7. Limitation of Liability

Podgorica Cars operates as an online booking intermediary. The actual rental of the vehicle is a transaction between you and the car hire supplier. Accordingly, Podgorica Cars is not a party to the rental agreement and does not assume the responsibilities of a vehicle supplier.

To the maximum extent permitted by applicable law, Podgorica Cars shall not be liable for any direct, indirect, incidental, special, or consequential losses arising from your use of our platform, including but not limited to: vehicle breakdowns, accidents, theft, delays, disputes with suppliers, or loss of personal belongings from a rental vehicle.

Our total liability to you in connection with any booking or service shall not exceed the total booking fee paid to us through the platform in respect of the affected reservation. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for any other matter that cannot be excluded or limited under applicable law.

8. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Montenegro. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Podgorica Municipality, Montenegro.

If you are a consumer resident in an EU member state, you retain the right to bring proceedings in the courts of your country of residence where mandatory consumer protection laws of that country apply.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
